The petitioners seek bail in connection with Narpatganj P.S.Case No. 254 of 2017 registered under Sections 120B, 302 and 328/34, 366A and 376 of the Indian penal Code. Learned counsel for the petitioners submits that there is no specific allegation against these petitioners, petitioners have no criminal antecedent and they are in custody since 06.05.2018.
It is alleged in the written report that these petitioners along with other accused persons went in the village for Panchayati. It is further alleged that the informant got information at 13:30 P.M. that her husband has died and his
Patna High Court Cr.Misc. No.53757 of 2018(3) dt.11-10-2018 2/2 dead body is lying at the door of Muneshwar Mallik. She went there and found the dead body of her husband at the door of Muneshwar Mallik.
Case diary has been received wherein copy of postmortem report is available.
Learned APP, after looking into the case diary, submits that the doctor has opined that no definite opinion can be given regarding cause of death.
Considering the aforesaid fact and circumstances, the prayer of bail of the petitioner is allowed. The petitioner, abovenamed, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Araria in connection with Narpatganj P.S. Case No. 254 of 2017 with condition that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) sujit/- U T
