The petitioner seeks bail in connection with Madhepura P.S. Case No. 152 of 2019 registered for the offences punishable under Sections 379 and 411 of the Indian Penal Code.

The F.I.R. of the occurrence of theft of motorcycle is against unknown.

The petitioner has been made accused on the basis of confessional statement of co-accused Om Prakash and there is recovery of motorcycle from the co-accused of Om Prakash. Learned counsel for the petitioner submits that the co-accused Om Prakash has been granted bail by a Co-ordinate Bench of

Patna High Court CR. MISC. No.72989 of 2019(2) dt.27-11-2019 2/2 this Court on 22.08.2019 passed in Cr. Misc. No.50306 of 2019. In the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of J.M. Ist Class, Madhepura in connection with Madhepura P.S. Case No. 152 of 2019, subject to the following conditions :

(a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of t he learned court below.
