The petitioner seeks bail in Suryapura P.S. Case No.105 of 2018 registered under Sections 30(a) and 38 of Bihar Prohibition and Excise Act.

About 440 liters of Indian made foreign liquor was recovered from the cattle house of the petitioner. The learned counsel for the petitioner submits that cattle house of the petitioner is an open place and there is no material to show that the petitioner had kept the liquor in his cattle house. The petitioner has remained in jail for about six months.

It appears that petitioner is accused in another case being Suryapura P.S. Case No.102 of 2018 but the petitioner has

Patna High Court CR. MISC. No.77182 of 2019(3) dt.16-03-2020 2/2 already remained in jail for about six months. Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional District and Sessions Judge-cum-Special Judge, Excise, Rohtas, Sasaram in connection with Suryapura P.S. Case No.105 of 2018.
