2. The petitioner seeks regular bail in connection with Garkha P.S. Case No. 517 of 2025 registered for the offence under Section(s) 126(2), 115(2), 352, 329(3), 74, 303(2), 103(1) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution case, the petitioner and others are accused of assaulting the victim and pushing him from the bridge.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 19.09.2025. There is general and omnibus allegation against the petitioner. There is no external injury found on the body of the deceased. He further submits

Patna High Court CR. MISC. No.78927 of 2025(2) dt.19-11-2025 2/2 that the post-mortem report does not support the prosecution case. The deceased is said to have been died because of heartattack.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Chapra/concerned Court below in connection with Garkha P.S. Case No. 517 of 2025.
