The petitioner seeks bail in Jokihat ( Mahalgaon) P. S. Case No. 380 of 2017 instituted for the offence under Section(s) 447, 341, 323, 324, 307, 379, 504 and 506/34 Indian Penal Code and Section 27 of Arms Act.

It is submitted that there is land dispute between the parties. Petitioner is in custody since 2.6.2018. In the written report, it is alleged that this petitioner made firing upon the informant which hit on the right rib of Md. Quddus who was standing near the informant. The injury report of Md. Quddus has been annexed as Annexure-3, wherein, the doctor has found no injury caused by fire arm. The doctor has found the injury to have been caused by hard and

There is case and counter case between the parties The counter case has been filed by the side of the petitioner vide Jokihat (Mahalgaon) P.S. case no. 381 of 2017 against the informant and three others which is annexed as Annexure-2 to the bail petition.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the CJM, Araria, in connection with Jokihat ( Mahalgaon) P. S. Case No. 380 of 2017 subject to the condition that both the bailers shall be the close relative of the petitioner.
