JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-12-2019 Heard learned counsel for the appellant and the learned counsel appearing on behalf of the State. This appeal is directed against the order dated 23.10.2019 passed by the learned 1st Additional Sessions Judgecum-Special Judge SC/ST (P.O.A.) Act, East Champaran at Motihari in Pipra P. S. Case No.103 of 2017 registered under Sections 341, 447, 323, 325, 307, 354, 427, 504, 506/34 of the Indian Penal Code and Section 3(iii) of SC/ST Act. As per the F.I.R. appellant is said to have assaulted the informant on his hand causing fracture of his hand. Submission of learned counsel for the appellant is that there is case and counter case in between the parties and he is under custody for about two months.

Learned Special P.P. opposed the prayer.
