The petitioner seeks pre-arrest bail in Jhajha P.S.Case No.181 of 2018 registered for the offences under Sections 406 and 420 of the I.P.C.

Accusation is that the informant Raj Kumar Sah used to run the committee with the petitioner Bachchan Gupta and on different occasions after collection total amount Rs.8,77,000/- were given to the petitioner Bachchan Gupta in presence of the members of the committee and on 17.05.2018 while upon pressure on the informant put by the members of the committee to refund their amount, the informant went to the petitioner and asked him to return the said amount, the petitioner refused to return the said

Submission of the learned counsel for the petitioner is that, in fact, the informant had taken loan from the petitioner and when he requested him to return the same then he filed the present false case and the petitioner has no criminal antecedent. Learned A.P.P. also opposed the prayer for anticipatory bail of the petitioner.

Considering the facts and circumstances of the case, stated above, let the petitioner, in the event of his arrest or surrender before the learned court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of S.D.J.M., Jamui, in Jhajha P.S.
