JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-02-2020 This application has been filed for cancellation of bail granted to Opp.Party no.2 by learned 2nd Additional Sessions Judge, Bhojpur, Ara in B.P.No.489 of 2019 in connection with Ara Navada P.S. Case No.355 of 2018 registered under Sections 420, 406 and 504 of the Indian Penal Code on the ground that it has been found that two cheques for Rs.10 lacs and 12 lacs respectively were issued in the name of "Prasad Institute of Medical Science and Opp.Party no.2 has no concern with the above cheques.
Submission of learned counsel for the petitioner that Opp.Party no.2 has misrepresented the fact before the court below and, as such, Opp.Party no.2 has been granted bail.

No.80892 of 2019(2) dt.17-02-2020 2/2 I have perused the order granting bail to Opp.Party no.2, from which it appears that the order granting bail has been passed on consideration of materials available on the record. There is no allegation of misuse of privilege of bail or tampering with the evidence.
