JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-12-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 272 and 273 of the Indian Penal Code and Sections 30(a), 34, 36 and 41 of the Bihar Prohibition and Excise Act, 2016.

Petitioner is in jail custody since 12.9.2019 on the accusation that a huge quantity of Indian made foreign liquor was recovered from the courtyard of the house of the petitioner as well as in front of his house. Petitioner does not have criminal antecedents, which is evident from perusal of para 3 of the petition.
