====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 18-11-2019 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in a case for the offence registered under Sections 341, 506, 307 of the IPC and 27 of the Arms Act.

The prosecution story, in brief, is that on 19.08.2019 at about 7.45 P.M. the informant was returning his house after closing his shop. In the meantime, some unknown criminals opened fire on him. He fell down on the earth. It is further alleged that one month ago from the date of occurrence, a threatening call and message was made from Mobile No. 7319187757 who disclosed his name as Sunil Tiger on the Mobile Phone of the informant bearing No. 9801878636.

Patna High Court CR. MISC. No.73421 of 2019(2) dt.18-11-2019 2/2 It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since 10.09.2019. The petitioner has got no criminal antecedent. The petitioner has falsely been implicated in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. There is no substantive evidence to suggest the implication of the petitioner in the present case. None is said to have been injured in course of occurrence.

On behalf of the State and the informant, it is submitted that the petitioner is not named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. Sherghati, Gaya, in connection with Imamganj P.S. Case No. 144 of 2019.
