The petitioner is in custody in connection with Siwan Town Police Station Case No.647 of 2017, registered for the offence punishable under Section 302, 379/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. With reference to the order of Sessions Judge, he submits that in the instant case on completion of the investigation charge-sheet under Section 304(A), 379/34 I.P.C. has been submitted in the instant case. Considering the aforesaid facts that the petitioner is in custody since 16.5.2018 and after completion of investigation police has already been submitted charge-sheet under Section
