The petitioner seeks bail in Chapra Town P. S. Case No. 148 of 2018 instituted for the offence under Section(s) 366A of the Indian Penal Code.

Learned counsel for the petitioner has submitted that petitioner is father of co accused Dipak Kumar. The victim girl has performed marriage with Dipak Kumar. In support of such submission, he has attached the certificate of the registration of marriage vide Annxure-2.

No.54503 of 2018(3) dt.08-10-2018 2/3 Learned counsel for the petitioner has filed supplementary affidavit in which a petition filed in the Court below on behalf of the victim girl has been enclosed as Annexure-2, wherein, the victim girl has stated that she has performed marriage with son of the petitioner and is also pregnant.

Learned counsel for the State has submitted that there is no whisper in the case diary about performing marriage of the victim with Dipak Kumar.

From perusal of Annexure-2, it appears that both victim and Dipak have performed marriage. In support of such submission petitioner has filed the certificate of the registration of marriage issued by Sub Registrar office Balia. The victim girl has filed a petition in the Court below which is annexure-2 to the supplementary affidavit, wherein, she has stated that she performed marriage with the petitioner and she is pregnant.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the CJM Chapra, Saran in connection with Chapra Town P. S. Case No. 148 of 2018 subject to the
