This application has been filed for quashing the order dated 06-10-2009 passed by learned Chief Judicial Magistrate, Madhubani in Tr. No. 734 of 2018 arising out of Pandaul P.S. Case No. 207 of 2004 whereby and whereunder, the learned court below took cognizance against the petitioner for an offence under Sections-406, 420, 409 & 379 of the Indian Penal Code.

After some argument, learned counsel for the petitioner seeks permission to withdraw this application with liberty to raise his defence before the court below at the time of framing of charge.

Patna High Court CR. MISC. No.85170 of 2019(3) dt.25-02-2020 2/2 Permission is accorded.

Accordingly, this application is disposed of with the aforesaid liberty.
