The petitioner seeks bail in Rupaspur P. S. Case No. 247 of 2018 instituted for the offence under Section(s) 392 Indian Penal Code and Section 37(b)( c) of the Bihar Prohibition and Excise Act, 2016.

Petitioner has clean antecedent. Petitioner is in custody since 29.6.2018 It is alleged in the written report that while the informant was going on a motorcycle , three persons seating on a motorcycle near R.P.S. crossing snatched the Vivo company mobile phone of the petitioner and tried to run away. One of the

Patna High Court Cr.Misc. No.54622 of 2018(3) dt.27-09-2018 2/2 miscreant was apprehended with help of local people along with motorcycle. Two miscreants managed to run away. The apprehended miscreant was brought to the police station by the informant who disclosed his name as Rahul Kumar @ Chhotu (petitioner). The people found him in intoxicated condition. He was examined through breath analyzer test and found 51.7 mg/100 ml.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge Excise Act, Patna in connection with Rupaspur P. S. Case No. 247 of 2018 Special case no. 5687 of 2018, subject to the condition that both the bailers shall be the close relative of the petitioner. (Sanjay Priya, J) shyambihari/- U T
