Mr.Rabindra Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 20-12-2023 Heard learned counsel for the petitioner, informant and learned A.P.P appearing on behalf of the State.

The petitioner is languishing in custody in a case registered for the offences punishable under Sections 341, 323, 307, 379, 342, 504, 506, 34 of the Indian Penal Code.

It is alleged that all the F.I.R named accused persons including the petitioner assaulted the informant and his brothers, as a result of which they sustained

Patna High Court CR. MISC. No.81291 of 2023(2) dt.20-12-2023 2/3 injuries. The accused persons also snatched the mobile and cash of Rs. 7000/- of the informant's brother. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. There is land dispute between the parties from before and in the background of free-fight, both sides sustained injuries. The injury report of the injured have been brought on record as Annexure-P3 which suggests that they sustained simple injuries. The petitioner is languishing in custody since 04.09.2023.

In contra, learned counsel appearing on behalf of the informant and learned A.P.P appearing on behalf of the State have vehemently opposed the prayer for bail of the petitioner.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount
