SONI SHRIVASTAVA ORAL ORDER 04-08-2025 Heard learned counsel for the petitioner, learned counsel for the OP.No.2 and the learned APP for the State.

2. Petitioner apprehends his arrest in a case registered for the offences punishable under sections 323,498A of the Indian Penal Code.

3. The case is one under section 498A and the petitioner is husband. The complaint case discloses an allegation of demand of dowry and torture.

4. The matter had been sent to the Patna High Court, Mediation Center for reaching an amicable settlement between the parties and it would appear from the Memorandum of Agreement dated 16.07.2025 passed in Mediation Proceeding no. 568 of 2025 that the issues has been resolved between the parties and a decision for one time settlement has been arrived at upon payment of Rs. 4,51,000/- to the opposite party no. 2 by

Patna High Court CR. MISC. No.83735 of 2024(4) dt.04-08-2025 2/2 the petitioner as article mentioned in the said memorandum of agreement.

5. Learned counsel for the OP.No. 2 also agrees to the terms and conditions as stated in the memorandum of agreement.

6. Considering all the above mentioned facts and circumstances, let the above named petitioner, in the event of his arrest/ surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/ successor court in Katra P.S. Case no. 229 of 2023 subject to condition as laid down under section 438(2) of the Cr.PC.

7. However, it is expected that both the parties strictly adhered to the terms and conditions as agreed between them and in case of flouting of the said terms and conditions of the settlement , the parties would be take legal recourse. N.K/- (Soni Shrivastava, J) U T
