JUSTICE ARUN KUMAR JHA ORAL ORDER 02-02-2024 Learned senior counsel appearing on behalf of the petitioner submits that this is the second attempt of the petitioner to seek bail from this Court. Earlier the prayer for bail was rejected by this Court vide order dated 07.11.2022 passed in Cr. Misc. No. 69587 of 2021.

2. After some argument, learned senior counsel appearing on behalf of the petitioner seeks permission to withdraw the present petition with liberty to move before the learned trial court seeking regular bail.

3. Permission is accorded.

4. Accordingly, the present petition is dismissed as withdrawn with liberty as aforesaid.

5. The learned trial court shall consider the prayer for

Patna High Court CR. MISC. No.83757 of 2023(3) dt.02-02-2024 2/2 bail whenever it is moved on its own merit without being prejudiced by rejection order dated 07.11.2022 passed in Cr. Misc. No. 69587 of 2021.
