The petitioner, who is in custody, seeks bail in connection with Narhat (Sitamarhi) P.S. Case No. 60 of 2016 registered for the offence punishable under Sections 147, 148, 149, 302, 337, 171(C), 188, 504 of the Indian Penal Code and 27 of the Arms Act.

Allegation against petitioner is that at his instigation, Manish Kumar @ Gore Singh fired from his pistol causing firearm injury to Sunil Kumar Sharma who subsequently died. There is no allegation of any overt act against petitioner. Petitioner is accused in one case and he is in custody since 11.07.2018.

Learned Counsel for the informant has vehemently

Patna High Court Cr.Misc. No.54907 of 2018(2) dt.18-09-2018 2/2 opposed the prayer for grant of regular bail to the petitioner. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Nawada, in connection with Narhat (Sitamarhi) P.S.
