2. The petitioner seeks bail in connection with Bikramganj P.S. Case No. 201 of 2016 registered for the offence under Sections 302, 201, 120(B)/34 of the Indian Penal Code.

3. As per the prosecution case, the dead body of the deceased was recovered and the informant suspected the hand of salesman Navratan in the death of the deceased.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he is not named in the FIR and his name has come in Paragraph 21 of the case diary. He further submits that similarly situated accused persons have been granted bail including Navratan.

Patna High Court CR. MISC. No.84282 of 2023(2) dt.10-01-2024 2/2 petitioner that the petitioner has one criminal antecedent and he is in jail since 11.04.2023.

6. Learned APP for the State vehemently opposed the prayer of the petitioner for grant of bail.

7. Considering the aforesaid facts and the period of custody, this application is allowed.

8. Let the petitioner, above named, be released on bail after framing of charge on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-XIX, Rohtas in connection with Bikramganj P.S. Case No. 201 of 2016.

9. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial and if he will not properly co-operate in the trial then his bail bonds shall be cancelled.
