JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends her arrest in connection with Agamkuan P.S. Case No. 99 of 2017 registered for the offences punishable under Sections 419, 420, 467, 468, 471 and 120B of the Indian Penal Code.
The petitioner was Branch Manager of Panjab National Bank at the relevant time and in course of investigation, it came to light that she recommended for sanction of loan. However, it is informed that prime accused namely, Jai Shanker and his wife Sunita Devi have already been admitted to anticipatory bail by different Benches of this Court and, similarly, one Shyama Nand Thakur, who was also a recommending
Patna High Court Cr.Misc. No.57141 of 2018 (2) dt.20-09-2018 2/2 authority for sanction of loan has also been granted privilege of anticipatory bail vide order dated 09.08.2018 passed in Cr. Misc. No. 43523 of 2018.
Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of her arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna in Agamkuan P.S. Case No. 99 of 2017 subject to condition as laid down under Section 438(2) of the Cr.P.C. (Hemant Kumar Srivastava, J) N.K/- U T
