JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-11-2019 Petitioners seek bail in anticipation of their arrest in connection with Dharhara P.S. Case No. 155 of 2019, registered for the offences punishable under Sections 363, 366 (A), 120 (B), 34 of the Indian Penal Code.

As per F.I.R minor daughter of the informant was traceless and petitioners and other accused persons are made accused in this case.

Submission of the learned counsel for the petitioners is that statement of victim recorded under Section 164 Cr.P.C. in which she has not disclosed the name of the petitioner rather she disclosed the name of one Vikash Kumar and there is no allegation of keeping or any other overt act against them.

Patna High Court CR. MISC. No.73237 of 2019(2) dt.19-11-2019 2/2 On the other hand, learned A.P.P. has opposed the bail prayer of the petitioners on the ground that she is minor. Having heard both sides, considering the above submission, this application allowed. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within three weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Five Thousand) each with two sureties of the like amount to the satisfaction of learned JM-1st, Class, Munger in connection with Dharhara P.S. Case No.-155 of 2019, subject to the condition laid down under Section 438

(2) of the Code of Criminal Procedure and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned with further condition that they shall cooperate in the investigation and no way taken the victim girl or his family members otherwise his bail bonds shall be cancelled.
