1. Heard the parties.

2. The petitioner seeks regular bail in connection with Sursand P.S. Case No. 300 of 2022 dated 12.06.2022 registered for the offence under section 467, 468, 471, 420 / 34 of the I.P.C. and section 14 of the Foreigners Amendment Act, 2004.

The prosecution case in brief is that on 11.06.2022 at about 6:45 hours, the informant, who is a Constable in 51st Battalion S.S.B., Sitamarhi noticed two suspicious persons near Pillar No. 301 of the Indo - Nepal border on the Indian side moving towards Nepal and apprehended them and upon interrogation it came to light that both were Chinese nationals not carrying any valid documents authorizing their stay in India.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence in the manner alleged. The petitioner is not named in the F.I.R. The name of the petitioner surfaced for the first time during course of investigation. The petitioner was remanded in the present case from Greater Noida Beta- 02 P.S. Case No. 408 / 2022 without there being any direct, cogent or circumstantial evidence linking him with the commission of the alleged offence. The petitioner is in custody since 12.03.2024.

This court vide order dated 30.03.2026 has called for a report from the court below regarding the present stage of the trial and in pursuance of the same learned S.D.J.M., Pupri at Sitamarhi vide letter no. 93 / 2026 has furnished the report. From perusal of the report it is evident that out of four witnesses, three witnesses have been examined and only one witness remains to be examined. The estimated time for conclusion of the trial has been given by the court below as six months.

6. Regard being had to the submissions made by the parties, taking into consideration the nature of allegation, the gravity of offence and the fact that petitioner has four criminal antecedent of similar nature of offence, accordingly, I am not
