The petitioner seeks bail in a case initially registered under Sections 363 & 365 of the Indian Penal Code and later on, Sections 364A, 302, 201, 120-B of the Indian Penal Code was also added.

The prosecution case in brief is that the informant's son was kidnapped by unknown persons. On search, no trace was made.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 01-07-2019. Charge sheet has already been submitted. The petitioner is not named in the FIR. There is no eye witness to the alleged

Patna High Court CR. MISC. No.74215 of 2019(3) dt.05-03-2020 2/2 occurrence nor there is any circumstantial evidence to suggest the participation of the petitioners in the present case. The only material is that at the relevant time, the petitioner had used his mobile and had talked with other persons who are also suspected accused in the present case.

On behalf of the State, it is submitted that the petitioner is not named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, the petitioner named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram (T) (Modal) P.S.
