The petitioner seeks regular bail in connection with Nayagaon P.S. Case No.07 of 2018 registered for the offences punishable under Sections 457, 380, 411/34 of the Indian Penal Code.

It has been submitted that the petitioner is neither named in the F.I.R. nor any incriminating material has been recovered from his possession. The name of this petitioner appeared in the confessional statement of co-accused Saurabh Kumar, who has been allowed bail by learned court below. The other co-accused Kumod Pathak has also been granted bail by one of the coordinate bench of this court in Cr.Misc.No.49989 of

Patna High Court Cr.Misc. No.55960 of 2018 (2) dt.28-09-2018 2/2 2018. The case of this petitioner stands on similar footing. He is in custody since 04.04.2018 having clean antecedent and so he deserves bail.

The learned A.P.P. for the State opposed the submission.

Considering the facts and circumstances of the case, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Nayagaon P.S.
