1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks regular bail in connection with Ara Mufassil P.S. Case No. 299 of 2023 for the offences registered under Section 376 D of the Indian Penal Code and Section 4 of the POCSO Act.

3. As per the prosecution case, the informant along with her friend Imran went on his motorcycle and when they stopped at road side at Bara Gaon, four accused persons taken key of motorcycle and three of them committed rape to her and one co-accused is said to have made video of the alleged

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He further submits that there is no active role of the petitioner in the alleged occurrence. Petitioner has three criminal antecedent in which he is on bail. The similarly situated co-accused, namely, Vidyanand @ Vidyanand Yadav has been granted regular bail by this Court vide order dated 05.01.2024 passed in Cr. Misc. No. 81843 of 2023 and co-accused, namely, Babudhan @ Babua has been granted regular bail by a coordinate bench of this Court vide order dated 05.12.2023 passed in Cr. Misc. No. 67199 of 2023. The petitioner is in judicial custody since 14.07.2023.

5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.

Considering the submissions made on behalf of the parties, facts and circumstances of the case and period of custody of the petitioner, let the petitioner, above-named, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned concerned Court where
