By way of present modification, the petitioners seek to modify the order dated 04.04.2018, by which the prayer for anticipatory bail of petitioner no. 3 was allowed and he was directed to surrender before the court below for furnishing the bail bonds and prayer for anticipatory bail of petitioner nos. 1 and 2 was disposed of and they were directed to surrender before the court below and pray for regular bail.

Submission of learned counsel for the petitioners as the petitioner no. 3 fell ill, he could not surrender within the time as mentioned in the order dated 04.04.2018 and, therefore, further time of two weeks may be allowed to petitioners to surrender before the court below.

Patna High Court Cr.Misc. No.55197 of 2018 (2) dt.05-09-2018 2/2 Considering the facts and circumstances of the case, I am not inclined to interfere with the order dated 04.04.2018, rather petitioner no. 3 should surrender and pray for regular bail and the court below after considering the fact that the petitioner no. 3 has already been granted the privilege of anticipatory bail by this Court vide order dated 04.04.2018, shall pass an appropriate order, if possible on same day.

So far petitioner nos. 1 and 2 are concerned, they should surrender before the court below and pray for regular bail, which will be considered on the basis of materials available on record without being prejudiced by the order of this Court. With the above observation, this application is disposed of.
