Petitioner, who is in custody, seeks bail in connection with Madanpur P.S. Case No. 233 of 2010 registered for the offences punishable under Sections 3⁄4 of Explosive Substance Act, under Section 27 of the Arms Act and under Section 17 of the C.L.A. Act.
Informant who is a police officer has stated that on 28.10.2010 when he was on combing operation against extremist along with other police personnel he got an information of installation of land mines. He reached at the said place where upon seeing the police personnel extremists assembled there fled away.
Patna High Court Cr.Misc. No.54101 of 2018(3) dt.26-11-2018 2/2 It has been submitted on behalf of the petitioner that he is innocent. He has been falsely implicated in this case due to local politics. No specific allegation is made against petitioner. Nothing has been recovered from his possession. He is in custody since 30.04.2016. It has been further submitted that similarly placed co-accused persons have been granted bail by another co-ordinate Bench of this Court as contained in Annexure-2 series.
Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-1st, Aurangabad in connection with Madanpur P.S. Case No. 233 of 2010.
