JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Complaint Case No. 757 (c) of 2014 for offenses punishable under Sections 323 of 498 (A) IPC.

Learned counsel for the petitioner submits that petitioner is the husband of the complainant. He has no criminal antecedent. The petitioner is ready to keep his wife with full honor and dignity but the wife is not ready in restoring his peaceful conjugal life.

Considering the aforesaid, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.54275 of 2018(2) dt.20-09-2018 2/2 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Danapur, Patna in connection with Complaint Case No. 757 (c) of 2014, subject to the condition that the petitioner will file an undertaking before the court below that he is ready to keep the complainant with full honor and dignity.

On filing the undertaking by the petitioner, the court below will refer the matter for mediation and after the report of the Mediation Board the court below will proceed further. In the event the husband is not willing to keep his wife in that event the court below shall be at liberty to cancel the bail bond of the petitioner.
