The petitioners are apprehending their arrest in a case registered under Sections 153, 153(A), 295(A) of the Indian Penal Code and Section 66 of the Information Technology Act. Allegation is that the accused persons were trying to disturb the communal harmony by posting messages on the face book.

It has been submitted on behalf of the petitioners that the petitioner No.2 has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have been made accused due to

Patna High Court CR. MISC. No.83185 of 2019(2) dt.20-12-2019 2/2 mistake of fact. The petitioners had no intention to hurt religious centiment of any individual. No such complaint was made in respect of post in question on the face book. A self cognizance was taken by the Sub Inspector.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Umesh Prasad, 1st class, J.M., Jehanabad in connection with Kako P.S. case No.241 of 2019 (G.R. No.1799 of 2019), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
