The petitioner, who is in custody, seeks bail in connection with Motipur P.S. Case No. 100 of 2018 registered for the offence punishable under Sections 401 of the Indian Penal Code and 25 [1-b] a, 26, 35 of Arms Act. Informant is the police officer, who in his self statement has stated that on secret information he reached Mahwalour Balmi village near Mandir, on seeing the police jeep three miscreants fled away, however one of them Md. Imam (petitioner) was apprehended after chase, and two persons managed to flee away. On search one loaded pistol, two live cartridges and also one mobile were recovered from possession

It has been submitted on behalf of the petitioner that petitioner is innocent and has been falsely implicated in this case. It has been further submitted that allegation made in the FIR is false and baseless. Petitioner is in custody since 20.02.2018.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., West Muzaffarpur, in connection with Motipur P.S. Case No. 100 of 2018.
