JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends her arrest in connection with Kazi Mohammadpur P.S. Case No. 401 of 2015 registered for the offences punishable under Sections 419, 420, 467, 468, 471, 406, 323, 504, 120B of the Indian Penal Code.
Petitioner happens to be wife of co-accused Alok Kumar Srivastava, who allegedly instigated the informant to invest huge amount in the Maahalaya Company and on the instigation of co-accused Alok Kumar Srivastava and others, the informant invested huge amount but subsequently, when her deposit got matured, the F.I.R named accused along with petitioner refused to

However, it is informed that co-accused Alok Kumar Srivastava has already been granted privilege of regular bail with condition vide order dated 21.02.2018 passed in Cr. Misc. No.12632 of 2017. It is also informed that several other cases were lodged against the petitioner and in that case petitioner has already been granted privilege of anticipatory bail by different Benches of this Court.
Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of her arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate,-XII, Muzaffarpur in Kaji Mohammadpur P.S. Case No. 401 of 2015 subject to condition as laid down under Section 438(2) of the Cr.P.C.
