The petitioner seeks pre-arrest bail in connection with Mahila P.S. Case No.52 of 2018 registered under Sections 341, 323, 354B, 379, 506 and 504 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that though the alleged occurrence of offence is said to have taken place on 03.06.2018 at 1.30 p.m., the FIR has been instituted on 05.06.2018. The informant happens to be the aunt of the petitioner and the FIR has been instituted only due to some family feud of petty nature.
Learned counsel for the State has opposed the prayer
Patna High Court Cr.Misc. No.56867 of 2018 (2) dt.06-10-2018 2/2 for grant of pre-arrest bail to the petitioner. Having regard to the nature of offence and the submissions made above, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Araria in connection with Mahila P.S. Case No.52 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Ashwani Kumar Singh, J) Md.S./- U T
