The petitioner seeks bail in a case registered for the offence punishable under Sections 379 of the Indian Penal Code.

The motorcycle of the informant is said to have been stolen by some unknown miscreants.

It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. He has been falsely implicated in this case. There is no eye witness of the occurrence. There is nothing cogent on recored indicating the complicity of the petitioner in the occurrence barring the confessional statement of co-accused Laltu Yadav

Patna High Court CR. MISC. No.72889 of 2019(2) dt.11-12-2019 2/2 which has no evidentiary value in the eye of law. The motorcycle in question has not been recovered from the house of the petitioner rather from Gumti bridge. Though three cases have been lodged against the petitioner but all have been lodged after the occurrence under hand. Similarly situated co-accused, namely, Dhirendra Yadav has been enlarged on bail by a coordinate bench of this court vide order dated 25.11.2019 passed in Cr. Misc. No.73061 of 2019. The petitioner has been languishing in custody since 08.04.2019.

Learned APP for the State opposed the bail petition.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in connection with Madhepura P.S. Case No.154 of 2019.
