Petitioner prays for bail in connection with Mahila P.S.Case No. 35 of 2018 registered for the offences punishable under Sections 376, 420 and 506 of the Indian Penal Code. Allegation as per FIR is that the petitioner was live in relation with the victim girl on the pretext of marriage since 3 years and one female child was born and petitioner refused to marry her and married with another girl.

Submission of learned counsel for the petitioner is that FIR shows that earlier also a case was lodged which was compromised between the parties and the present case has been filed in order to create pressure upon the petitioner to marry her and as a matter of fact no such occurrence has taken place and

Patna High Court Cr.Misc. No.58021 of 2018 (2) dt.08-10-2018 2/2 petitioner is in custody since 12.5.2018 and charge sheet has been submitted in this case.

Heard learned APP also.

Having heard both sides and in the facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Darbhanga, in connection with Mahila P.S.Case No. 35 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
