2. The petitioner apprehends his arrest in a case registered under Sections 341, 324, 307, 504/34 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per F.I.R., co-accused Gorakh Singh fired upon informant due to which, he sustained injury.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to village politics. Further submission is that allegation of firing is against co-accused Gorakh Singh. No specific over act has been alleged against this petitioner. The First Information Report has been lodged after inordinate delay of 10 days without any explanation which
Patna High Court CR. MISC. No.83007 of 2024(2) dt.27-01-2025 2/2 renders the entire prosecution case doubtful. Similarly situated co-accused persons have already been granted bail by this Court vide order dated 16.10.2023 passed in Cr. Misc. No. 64310 of 2023 (Annexure-P2 to the bail petition).
5. Learned A.P.P. for the State opposed the prayer for bail.
6. Having considered the aforesaid facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of eight weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-I, Saran at Chapra, in connection with Rivilganj P.S. Case No. 114 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Singh, J) utkarsh/- U T
