2. The instant application for regular bail has been filed by the petitioner registered for the offence punishable under Sections 363, 366(A) of the Indian Penal Code.

3. It is a case of kidnapping and abduction of the victim girl, daughter of the informant by the petitioner.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. Victim girl was recovered and her statement was recorded u/s 161 as well as 164 Cr.P.C. in which she has disclosed that she herself left her house due to ill behavior of her mother. Petitioner met her at Sasaram and she has not made allegation of physical misbehaving or physical

Patna High Court CR. MISC. No.81936 of 2023(3) dt.24-01-2024 2/2 assault. She has not raised any finger against the petitioner for any overt act. As per medical assessment, doctor has assessed her age as 18 to 19 years. Petitioner is languishing in judicial custody since 13.09.2023.

5. Learned APP appearing for the State has opposed the prayer of Bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned ACJM, Gaya in connection with Wazirganj P.S.
