The instance application for regular bail has been filed by the petitioner in connection with Hajipur (Town) P.S. Case No. 458 of 2021 instituted for the offence u/s 395, 412 of the Indian Penal Code.

Earlier, the application for bail of the petitioner was rejected by order dated 14.02.2023 passed in Cr. Misc. No. 12304 of 2022.

In pursuance to the direction of the Court, a Report with regard to present state of trial vide dt. 27.01.2024 has been received from which, it appears that out of 26 witnesses not a single witness has not been examined as yet and the

Patna High Court CR. MISC. No.4002 of 2024(4) dt.13-03-2024 2/2 learned trial Court had sought two years to conclude the trial. No fresh ground is made for reconsideration of the regular bail application of the petitioner. Accordingly, this application is rejected.

The bail application stands disposed of.

However, learned trial Court is directed to conclude the trial within nine months on day to day basis, as the petitioner is languishing in judicial custody since 22.07.2021, failing which the petitioner may renew his prayer for bail application.
