The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 30(a) and 34 of the Bihar Prohibition and Excise Act.
Learned counsel for the petitioners submits that they have been falsely implicated in this case and has no criminal antecedent. Learned counsel for the petitioners further submits that nothing has been recovered from the conscious possession of the petitioner, rather it is recovery of 29 lt. of IFML from the Vijay Rai co-accused.
In the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on
Patna High Court CR. MISC. No.73634 of 2019(2) dt.21-11-2019 2/2 furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Gardanibagh P.S. Case No.7567/2019, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, subject to after deposit of Rs.10,000/- at District Legal Services Authority, Patna.
