JUSTICE ASHOK KUMAR PANDEY ORAL ORDER 05-02-2025 Heard learned counsel for the petitioner, Mr. Brajendra Nath Pandey, learned APP for the State and Mr. Atul Kumar Mehta, learned counsel for the Informant.
2. The petitioner has prayed for bail in a case registered for the offence punishable under Sections 354(D) & 509 of the Indian Penal Code & Section 66(E), 67, 67(A) of the I.T. Act.
3. The case of the prosecution is that the informant is a teacher in Open Minds Birla School, Danapur, Patna. Her fake I.D. on social media has been created by the petitioner and on that I.D. obscene messages demanding cash are posted. The informant came to know that this is the work of this petitioner
Patna High Court CR. MISC. No.84027 of 2024(3) dt.05-02-2025 2/3 who is also an employee of the same school. It is further alleged that he has made several forged ID of the informant and has posed her as a sex worker due to which she is in stress.
4. Learned counsel appearing on behalf of the petitioner has submitted that earlier the husband of the informant has also filed a case against this petitioner at Muzaffarpur. It has also been submitted that the informant was living in live-in-relation with the petitioner as her relation with her husband is restrained. The learned counsel for the petitioner has submitted that the petitioner has been terminated from that school and he is in custody since 25.07.2024.
5. The application for bail is opposed by learned APP for the State as well as learned counsel for the Informant. The learned counsel for the informant has submitted that the act of the petitioner has left the informant in stress and she is saving herself but the petitioner is following her.
6. Having heard learned counsel for the parties and considering the above facts and circumstances, this Court is inclined to enlarge the petitioner on bail with a condition that the petitioner shall appear in the court regularly and co-operate in the trial. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees
Patna High Court CR. MISC. No.84027 of 2024(3) dt.05-02-2025 3/3 Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addition Chief Judicial MagistrateIVth, Patna in connection with Patna Cyber P.S. Case No. 732 of 2024.
7. Accordingly, the present bail application stands allowed.
