The petitioner, who is in custody, seeks bail in connection with Manjhagarh P.S. Case No. 219 of 2018 corresponding to G.R. No. 3331 of 2018 registered for the offence punishable under Sections 413, 414, 420, 467, 468, 471, 34 of the Indian Penal Code.
Allegation against petitioner is that he purchased stolen motorcycle from one co-accused Apu Ali. It has been submitted on behalf of the petitioner that name of petitioner has surfaced on confessional statement of co-accused persons. There is general and omnibus allegation against petitioner. Nothing has been recovered from the
Patna High Court Cr.Misc. No.56083 of 2018(2) dt.06-10-2018 2/2 possession of petitioner and the said motorcycle has been recovered from his mama's house. It has been further submitted that similarly placed co-accused, Mahmood Alam has been granted regular bail as contained in Annexure-2. Petitioner is in custody since 22.07.2018.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, in connection with Manjhagarh P.S. Case No. 219 of 2018 corresponding to G.R. No. 3331 of 2018.
