JUSTICE SANJAY PRIYA ORAL ORDER 28-09-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Rajepur P.S. Case No. 39 of 2018 instituted for the offence under Section 387 of the Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the written report. There is no recovery of any incriminating article from his possession. The name of petitioner has come in the confessional statement of co-accused Sushil Kumar.

Petitioner is said to be in custody since 10.07.2018. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail

Patna High Court Cr.Misc.
