2. The petitioner apprehends his arrest in case registered for the offences punishable under Sections 126 (2), 127 (2), 115 (2), 118 (1), 117 (2), 303 (2), 352, 3 (5) and 109 of the Bharatiya Nyaya Sanhita.

The allegation in the first information report is that all the accused came variously armed and surrounded the relative of the informant, Shekhar Singh and upon order being given by Sunil Singh (petitioner), Bipin Singh snatched the handbag from the hands of Shekhar Singh, while Sunil Singh assaulted Shekhar Singh on his head by means of rod. There are also allegation of assaulting the other persons.

4. Learned counsel for the petitioner submits that the

No.82952 of 2024(4) dt.09-07-2025 2/3 case arises out of a land dispute and both the parties are Gotiyas and a genealogical table has also been given in para-10 of the petition. On account of dispute with regard to share of property a title suit is also going on between the parties, which is sub judice before the concerned Court. Learned counsel for the petitioner further submits that with regard to the same occurrence a case had been filed on behalf of the petitioner on the same date, which is earlier in point of time from the present F.I.R., making allegations against the prosecution side indulging in assault of the wife of the petitioner. There is specific allegation against the petitioner of assaulting Shekhar Singh but the injury report of the said Shekhar Singh, which is recorded in para-19 of the case diary, would go to show that the injury is simple in nature.

5. Learned APP for the State opposed the prayer of anticipatory bail.

Taking into consideration the facts and circumstances of the case as well as the factum of case and counter case and the nature of the injury, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/-

Patna High Court CR. MISC. No.82952 of 2024(4) dt.09-07-2025 3/3 (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/ successor Court in connection with Pipra P.S. Case No.188 of 2024, subject to the condition as laid down under Section 482 (2) of the B.N.S.S.
