2.The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 317(4), 317(5) of the Bharatiya Nyay Sanhita.

3. The case of the prosecution is that a stolen bike was recovered from the possession of the petitioner. 4.Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. During investigation the owner of bike has given his statement in para-21 of the case diary that the seized motorcycle is in his ownership and in his custody. The petitioner is neither the owner nor he has any concern with the seized motorcycle. From perusal of the order

No.84769 of 2024(3) dt.10-02-2025 2/2 of the trial court it transpires that the bail of this petitioner has been rejected only on the basis that he is having criminal antecedents. It is further submitted that the petitioner is languishing in judicial custody since 04.09.2024.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6.Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Dumra P.S. Case No. 388 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Sitamarhi.
