JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-12-2019 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Pipra P.S. Case No. 300 of 2019 registered for the offences punishable under Sections 379 and 411of the Indian Penal Code.

The accusation against the petitioner is that he was illegally selling diesel and when the police raided the place, he managed to escape from there but in near about, 155 liters diesel was recovered from a lonely place.

Learned counsel appearing for the petitioner submits that petitioner had purchased the aforesaid diesel and had kept at that place but unfortunately, police seized the said diesel and lodged this false case. In support of his contention, he drew my

Patna High Court CR. MISC. No.74641 of 2019(2) dt.18-12-2019 2/2 attention to Annexure-2 to this petition.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran, Motihari in Pipra P.S. Case No. 300 of 2019 subject to condition as laid down under Section 438(2) of the Cr.P.C.
