ANJANA MISHRA ORAL ORDER 28-09-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. Learned counsel for the informant is also present.

The petitioner is in custody since 22.06.2018 in connection with Chapra Muffasil P.S. Case No.187 of 2018 registered for the offence under Sections 302/34 of the Indian Penal Code, which is pending in the court of learned Chief Judicial Magistrate, Saran at Chapra.

The allegation against the petitioner is that he along with one Chhotu Kumar @ Jhitu attacked the deceased Rajesh Kumar Singh and as a result of attack and the cumulative effect of the injuries, the deceased lost his life.

No.59446 of 2018 (2) dt.28-09-2018 2/2 It is submitted that the entire occurrence was witnessed by the informant and it was only after hectic effort being made to revive the deceased from the injuries, which proved futile, that the present FIR was lodged specifically naming the petitioner.

In view of the aforementioned facts and circumstances, I am not inclined to grant regular bail to the petitioner. It is, accordingly, rejected.
