2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 323, 379, 384, 504, 506, 34 of the Indian Penal Code and Section 50(c)(d) of the Bihar Prohibition and Excise Act.

3. As per prosecution case, the petitioner is SubInspector who is alleged to have demanded Rs. 5 lakh as extortion for releasing Ayodhya Singh who was apprehended by him along with 3 liters country made liquor.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. The petitioner has never demanded any illegal money from anyone and no any

The actual fact is that Ayodhya Singh and his son were arrested by the petitioner and his team but pairvikar of the accused persons tried to influence the petitioner. The petitioner is police official who has got no criminal antecedent. It is further submitted that he is languishing in judicial custody since 15.9.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody period, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Desari (Sahdei OP) P.S. Case No. 117 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No.1-Cum-Additional District and Sessions Judge, Vaishali at Hajipur.
