Petitioner, who is in custody, seeks bail in connection with Jokihat P.S. Case No. 307 of 2017 registered for the offences punishable under Sections 144, 188, 283, 290, 447, 323, 353, 153(A), (B), 295(A), 307, 427, 504 and 120(B) of the Indian Penal Code.

Informant who is the Block Development Officer, Jokihat has stated that when he was deployed as Magistrate for Muharram has received an information that some anti-social element creating nuisance near a temple during Moharram Procession and when he went there to prevent them accused persons became turbulent.

It has been submitted on behalf of the petitioner

Patna High Court Cr.Misc. No.56527 of 2018(2) dt.06-10-2018 2/2 that he is innocent. He has been falsely implicated in this case due to dirty village politics. He was only a member of the mob. FIR is against 17 named and 200-300 unknown accused. He has no criminal antecedent and he is in custody since 25.07.2018. It has been further submitted that similarly placed co-accused persons have been granted bail by co-ordinate Bench of this Court as contained in Annexure-2 series of this bail petition. Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Jokihat P.S. Case No. 307 of 2017.
