The petitioner seeks bail in Roh P. S. Case No. 69 of 2015 instituted for the offence under Section(s) 302, and 201/34 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner has submitted that petitioner is in custody since 9.1.2018 having no criminal antecedent.
In the written report, it is alleged that while Deoki Yadav @ Devki Yadav was doing funeral of his grand son, namely, Surendra Yadav with the villagers, the husband of informant was grazing the buffalo near the place of funeral. It is also alleged that seeing the husband of the informant ten named
Patna High Court Cr.Misc. No.56491 of 2018(5) dt.04-12-2018 2/3 accused persons as mentioned in the written report assaulted him with Khanti, lathi. The informant went to save her husband then she was also assaulted. It is further alleged that all the named accused persons in presence of the informant committed murder of her husband and threw the dead body on the funeral pyre of Surendar Yadav. The same also got burnt along with the dead body of Surendra Yadav. It is further alleged that Deoki Yadav @Devki Yadav brought kerosene oil in a gallon and put the same on the burning pyre in which the dead body of husband of informant was also burnt. Learned counsel for the petitioner has submitted that petitioner is son of Deoki Yadav @ Devki Yadav. He was not present on the spot. He is not named in the written report.
The name of this petitioner has come during investigation after two years in the supervision note of Dy S.P. and thereafter the charge sheet has been submitted against this petitioner. Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the 1st Additional Sessions Judge, Nawada, in connection with Roh P. S. Case No. 69 of 2015, G.R. No.
