2. The petitioner seeks bail in connection with Laukahi P.S. Case No. 227 of 2024 registered for the offences punishable under Sections 274, 275 read with Section 3(5) of the B.N.S. and Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.

3. As per the prosecution case, total 324 litres of Nepali Kasturi liquor is said to have been recovered from the Alto Car and Apache Motorcycle.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in the present case. The petitioner is not the owner of the said vehicles.

Patna High Court CR. MISC. No.79876 of 2025(2) dt.05-12-2025 2/2 His name has surfaced in the present case on the basis of the disclosure made by the local Chaukidar on suspicion. The other co-accused person has already been granted bail by this court vide order dated 28.03.2025 passed in Cr. Misc. No. 15127/2025. The petitioner has clean antecedent as stated in paragraph no. 3 of the bail application. The petitioner is in custody in this case since 13.10.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well the period of custody, let the above named petitioner, be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court of Special Judge, Excise Act, Jhanjharpur (Madhubani) in connection with Laukahi P.S. Case No. 227 of 2024.

7. The application stands allowed.
