JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-12-2018 The petitioner seeks regular bail in connection with Deodha P.S. Case No. 101 of 2017, registered for offences punishable under Sections 25(1-B)A, 26 and 35 of the Arms Act.
Allegation as per F.I.R. is that police on information that some persons have assemble to commit a crime raided the house of co-accused Ram Dayal Thakur, who disclosed that the arms and ammunition as well as looted currency has been kept by the petitioner Saroj Thakur, thereafter, the police party along with co-accused Ram Dayal Thakur went to the house of petitioner, where several arms and ammunition kept in the godown and also the Nepali currency of Rs. 2,30,350.00 and Indian currency of Rs. 91,940/- was recovered. Patna High Court Cr.Misc. No.63658 of 2018(4) dt.18-12-2018 2/2 has falsely been made accused in this case only on the disclosure made by the co-accused and nothing has been recovered from the conscious possession of the petitioner except one mobile and except that there is nothing against the petitioner. Further submission is that petitioner has been in judicial custody since 23.10.2017.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Madhubani, in connection with Deodha P.S. Case No. 101 of 2017, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
